According to the report, Impact Plastics did not notify TOSHA of worker deaths

ERWIN, Tenn. (WSMV) – After learning of four deaths at Impact Plastics when floods hit Erwin, Tennessee on Friday, the Tennessee Occupational Safety and Health Administration (TOSHA) opened an investigation into the company.

Since then, the Tennessee Bureau of Investigation (TBI) has also launched its own investigation into the circumstances leading to the deaths, replacing the TOSHA investigation.

Chris Cannon, TOSHA's chief communication officer, said Wednesday evening that Impact Plastics had not yet notified them of the employees' deaths.

“Tennessee law allows an employer eight hours to notify TOSHA of workplace fatalities,” Cannon said. “TOSHA has not received any death reports from managers at Impact Plastics.”

TOSHA and TBI are continuing their joint investigation into events between management and employees at Impact Plastics. TOSHA will inspect the site, review company documents and conduct interviews.

According to the agency, a typical TOSHA investigation into a workplace death takes up to six months.
