D.C. Supreme Court Justice Rainey Brandt postponed a decision on a defendant's release request to give prosecutors time to respond in writing on October 2.

Santos Duarte, 24, is charged with assault with intent to kill with weapon force, aggravated assault with weapon force and possession of a firearm during a crime of violence for his involvement in a non-fatal shooting July 5 at a restaurant and bar in the 3500 block of 14th Street, NW. One victim, the owner of the restaurant, suffered a gunshot wound to the leg.

During the hearing, Judge Brandt alerted Jonathan Lanyi, Duarte's defense attorney, to submit his request for bail reconsideration in writing and give the prosecution time to respond.

Lanyi also requested more time to discuss with Duarte the details of a plea agreement extended by the prosecution.

Lanyi said the plea deal would require Duarte to plead guilty to aggravated assault with a weapon, possession of a firearm during a crime of violence and assault with intent to kill in exchange for prosecutors not seeking charges.

The parties are scheduled to meet again on November 8th.
