An Oklahoma man is charged with a fatal heroin overdose from Davenport, police said

DAVENPORT, Iowa (KWQC) – An Oklahoma man is charged in connection with a fatal heroin overdose.

Andrew Giminiani, 38, is charged with persistent criminal conduct and unlawful activity, two counts of a controlled substance violation and involuntary manslaughter, according to court documents. A preliminary hearing is scheduled for Oct. 11.

The allegations made against Giminiani are based on the following.

On April 13, at approximately 3:51 p.m., Davenport police, firefighters and paramedics responded to an apartment at 2736 East 53rd Street in reference to a heroin overdose, according to an affidavit. The victim was pronounced dead by MEDIC. Investigators said they found drug paraphernalia and a USPS mail package with a tracking number.

According to the affidavit, investigators checked the victim's cell phone and found Facebook messages between Giminiani and the victim.

On April 12, Giminiani sent the victim the same tracking number that investigators found at the apartment and told the victim the package should be there the next day, according to the affidavit.

At approximately 2:56 p.m. on April 13, the victim told Giminiani, “It's here, I'm going to grab it,” the affidavit states. Around 3 p.m., surveillance video showed the victim retrieving the package from a locker in his apartment complex.

At approximately 3:15 p.m., the victim sent Giminiani a message saying, “It definitely contains fent (fentanyl) as long as it's not carfent (carfentanil) lol,” the affidavit states. Giminiani replied: “Yes, everything contains fent (fentanyl). This has better legs than straight Fent (fentanyl).”

Around the same time, the victim sent a message to a friend saying his package had arrived and appeared to contain fentanyl, according to the affidavit.
